1. Acceptance of Terms

By accessing or using Claro ("the Service"), operated by Claro ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Claro is a subscription-based software service that helps contractors discover, track, and understand government procurement opportunities in Canada. The Service includes tender matching, AI-powered summaries, bid tracking, and email notifications.

3. Accounts & Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years of age to use the Service.
  • One person or legal entity may not maintain more than one account.

4. Subscriptions & Payments

  • Some features of the Service require a paid subscription. Pricing details are available on our pricing page.
  • Payments are processed securely through Stripe. We do not store your full payment card details.
  • Subscriptions renew automatically at the end of each billing period unless cancelled.
  • You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Scrape, crawl, or use automated tools to extract data from the Service beyond normal usage.
  • Resell, redistribute, or sublicense access to the Service without our written consent.
  • Interfere with or disrupt the integrity or performance of the Service.

6. Tender Information & Accuracy

Claro aggregates publicly available tender information from government procurement portals. While we strive for accuracy, we do not guarantee that tender listings, AI summaries, match scores, or estimated values are complete, accurate, or up-to-date. Always verify details on the original government procurement portal before making business decisions.

7. AI-Generated Content

The Service uses artificial intelligence to generate tender summaries, match scores, and other insights. AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for business decisions. We make no warranties regarding the accuracy or completeness of AI-generated content.

8. Intellectual Property

The Service, including its design, features, and content (excluding government tender data), is owned by Claro and protected by intellectual property laws. You retain ownership of any data you submit to the Service, such as your company profile and bid notes.

9. Limitation of Liability

To the maximum extent permitted by law, Claro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.

12. Governing Law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.

13. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
